| dc.description.abstract | İslâm dini, temel anlamda birbirlerine karşılık gelen hak ve sorumluluk düzleminde erkek ve kadın arasında bir ayırım gözetmemiştir. Yaşam hakkı başta olmak üzere, eğitim, sağlık ve âdil yargılanma gibi birçok hakka kadın da erkek kadar sahiptir. Ancak ibadât, muamelât ve ukûbât gibi hak ve sorumlulukların farklı olduğu bazı konular da bulunmaktadır. Bununla birlikte İslâm, üstünlüğü hak ve sorumluluklara değil sadece takvâya bağlayarak kadının gerçek değerini takdir etmiştir. İslâm hukukçuları da naslar ekseninde gerçekleştirdikleri içtihatlarında kadınlara ihtiyaç haline göre kolaylaştırma prensibini devreye koymuşlardır. Bu bağlamda hayız veya nifas halindeki kadınlara bu durumları devam ettiği müddetçe namaz, oruç ve hac gibi ibadetlerde bazı ruhsatlar sağlanmıştır. Bu çalışmada hac ibadetinde kadın için tanınan muafiyetler konu edinmiştir. Böylece İslâm’ın kadınlara hak ettikleri değeri vermediği iddiasının hac ibadeti özelinde çürütülmesi hedeflenmiştir. Çalışma kapsamında klasik ve güncel kaynaklar taranarak konuyla ilgili veriler toplanmış ve değerlendirmelerde bulunulmuştur. Araştırma neticesinde İslâm hukukunun kadınlara gereken değeri verdiği ve diğer ibadetlerde olduğu gibi hac ibadeti esnasında da kolaylıklar sağladığı sonucuna ulaşılmıştır. | |
| dc.description.abstract | The religion of Islam has maintained a balance based on justice between men and women in terms of rights and responsibilities. Women have the same rights as men, including the right to life, as well as other rights such as education, health, and fair trial. However, there are also certain areas, such as acts of worship (?ib?d?t), transactions (mu??mal?t), and punishments (?uq?b?t), where rights and responsibilities differ. Nonetheless, Islam has acknowledged the true value of women by attributing superiority not to rights and responsibilities but solely to taqw?. Islamic jurists have also applied the principle of facilitation for women based on necessity in their ijtihads, which they carried out within the framework of the texts (nass). In this context, women experiencing menstrual or postnatal bleeding have been granted certain allowances in worship, such as prayer, fasting, and Hajj, as long as they remain in this state. This study focuses on the exemptions granted to women in the hajj ritual. Thus, it is aimed to refute the claim that Islam does not give women the value they deserve, specifically in the hajj ritual. In the scope of the study, classical and contemporary sources have been reviewed, and data related to the topic have been collected and evaluated. As a result of the research, it was concluded that Islamic law gives due value to women and provides convenience during the pilgrimage as in other acts of worship. | |
