Abstract
Bu araştırmada, öğrenci ve takipçilerinin yanı sıra hocalarını, çağdaşlarını ve kendinden
sonra gelenleri etkileyen meşhur âlim Ebû Tâlib el-Mekkî’nin hayatı ve fıkhî görüşleri ele
alınmıştır. Kendisi aslen Horasan diyarından olsa da doğma büyüme Mekkeli
olduğundan Mekkî nisbesini almıştır. İlim tahsili için birçok İslâm ülkesini dolaştıktan
sonra Bağdat’a yerleşip tasavvuf okulu kurmuştur. Meşhur eseri Kûtü’l-kulûb vasıtasıyla
tasavvufî öğretiyi yaymaya çalışmıştır. Onun bu eseri başta İmam Gazzâlî olmak üzere
pek çok âlimi etkilemiştir. Daha çok tasavvufî yönüyle bilinen Mekkî, fıkıhçı yönü de olan
bir âlimdir. Ancak onun fıkhî görüşleri derlenmiş değildir. Bu çalışmada fıkıh
kaynaklarında ona ait görüşlerin tespiti amaçlanmıştır. Bu bağlamda fıkhın ibâdât ve
muâmelât konuları başta olmak üzere pek çok konuda ona ait görüşlerin tespiti yapılmış
ve onun görüşleri diğer mezhep görüşleriyle mukayese edilmiştir. Araştırma sonucunda
Ebû Tâlib el-Mekkî’nin fıkhî görüşleri çoğunlukla cumhurun görüşüyle örtüşse de ibâdât
vb. konularda kendisine ait bazı özgün görüşlerinin de olduğu görülmüştür.
The research deals with the biography of Abū Tālib al-Makkī, the eminent scholar who influenced his contemporaries, including his sheikhs and students, and those who came after him as well. Although he was originally from Khorāsān, he received the title of Makkī, because he was born and raised in Mecca. After traveling to many Islamic countries for his education, he settled in Baghdād and founded a Sūfī school there. And spread its Sūfī doctrine through his book “Qūt al-Qulūb”, which influenced many scholars, most notably Imām al-Ghazali. Makkī, who is mostly known for his Ṣūfism, was a scholar who also had a fiqh side. However, his fiqh views have not been compiled. In this study, it is aimed to determine his views in fiqh sources. In this context, his views on many issues, especially the subjects of worship (‘ibādāt) and transactions (muʿāmalāt) of fiqh, were determined and his views were compared with the views of other sects. As a result of the research, it was seen that although Abū Tālib al-Makkī’s fiqh views mostly coincide with the views of the public, he also had some original views of his own on issues such as worship.
