| dc.description.abstract | Her beşerî medeniyette doğanın insan karşısındaki dışsallığı olarak tanımlanan çevre, doğa-insan dengesi bozulunca sorun haline gelmiştir. İleri sanayi toplumlarının tahribatıyla birlikte; dönüşüm sürecine girmiş olan çevrenin korunması anlamında politik değişim ihtiyacı artmıştır. Bu bağlamda, çevre politikasının yeniden yapılanma sürecinde ulus devletin değişen rolü yönetişim ekseninde sorgulanmaya başlanmıştır. Modern toplumun ve insanlığın ekolojik bunalıma girmesiyle yerel düzeyde ortaya çıkan çevre sorunları, küresel bir nitelik kazanmıştır. Nitekim çevre hakkının uluslararası ölçekte önem kazanmasıyla beraber çok taraflı çevre sözleşmeleri, küresel bağlamda çevre hukukunun zeminini inşa etmiştir. Doğal kaynakların ve varlıkların, ulus- devletlerce küresel boyutta nasıl bölüşüleceği ve paylaşılacağı hukuki anlamda ulusların çok yönlü işbirliğini gerekli kılmıştır. Bu çerçevede, çevre hakkının uluslararası boyutta öneminin artmasıyla ortaya çıkan hukuki ve kurumsal yapıyı çok taraflı çevre sözleşmeleri bakımından ele almak çalışmanın amacıdır. Dolayısıyla çalışmada, küresel çevre etiğinin karşılıklı etkileşimi çağrıştırması bakımından uluslararası çevre politikaları yönetişimin hukuki mekanizması ekseninde ele alınmaktadır. | |
| dc.description.abstract | The environment, which is defined as the externality of nature against human in every human civilization, has become a problem when the nature-human balance is disturbed. With the destruction of advanced industrial societies; The need for political change has increased in the sense of protecting the environment, which has entered the transformation process. In this context, the changing role of the nation state in the process of restructuring environmental policy has been questioned on the axis of governance. Environmental problems, which emerged at the local level with the ecological crisis of modern society and humanity, have gained a global character. As a matter of fact, with the increasing importance of environmental rights on an international scale, multilateral environmental conventions have built the foundation of environmental law in a global context. How the natural resources and assets will be divided and shared by nation-states on a global scale has necessitated the multi-faceted cooperation of nations in the legal sense. In this framework, the aim of the study is to deal with the legal and institutional structure that has emerged with the increasing importance of the environmental right in terms of multilateral environmental agreements. Therefore, in the study, in terms of evoking mutual interaction of global environmental ethics, international environmental policies are discussed in the axis of the legal mechanism of governance. | |
