| dc.description.abstract | Kamu alımlarını düzenleyen mevzuatla korunmaya çalışılan ilke, kamu faaliyetlerinin kamu yararı adına sağlıklı bir biçimde yürütülmesini sağlamaktır. Bu doğrultuda yapılan değişikliklerden birisi de doğrudan temin usulünün ihale usullerinden çıkarılmasıdır. Böylece ihale sürecinin katı hükümleri ve bürokratik işlemler aşılarak ihtiyaçların daha kolay yöntemlerle karşılanmasına çalışılmıştır. Ancak doğrudan temin sürecine sağlanan kolaylıklar, iyi niyetle yürürlüğe konulmasına rağmen, harcama sürecinde rol alan yetkililerin farklı tutumlar sergilemeleri, kamu aleyhine bazı riskleri de beraberinde getirmektedir. Bu bağlamda çalışmada doğrudan temin usulünde karşılaşılma ihtimali yüksek olan riskler ortaya konularak bunların minimize edilmesine yönelik öneriler getirilmesi amaçlanmaktadır. Çalışmada bir kamu idaresinin son bir yıl içerisinde gerçekleştirdiği doğrudan temin alımları belge tarama yöntemiyle incelenmiştir. Bu inceleme sonunda doğrudan temin usulünün birçok yönden idarelerin kamu yararı sağlayabilmesi açısından alıma konu işlerini kolaylaştırdığı fakat alımlarda yer alan görevlilere sağladığı inisiyatiflerin denetim mekanizmasıyla etkin denetlenmediği görülerek kanuna aykırı davranış riskini arttırdığı tespit edilmiştir. Bu riskin önlenmesi adına, gelişen teknolojiye paralel, kamu idarelerinde etkin bir iç kontrol mekanizmasının tesisinin, söz konusu risklerin ve kırılganlıkların önüne geçeceği görüşü üzerinde durulmuştur. | |
| dc.description.abstract | The main aim of the legislation governing public procurement is to ensure that public activities are conducted in a sound manner in the name of the public interest. One of the amendments made in this respect is the exclusion of the direct procurement method from procurement procedures. In this way, it is attempted to overcome strict provisions of the procurement process as well as bureaucratic procedures and to meet the needs with easier methods. However, despite the fact that the facilities provided to the direct procurement process are implemented in good faith, some risks may arise against the public due to the different attitudes of the authorities involved in the spending process. In this context, this study aims to present risks that are highly probable to be encountered in the direct procurement process along with suggestions for the minimisation of these risks. In the study, the direct procurements made by a public administration within the last year has been examined through document screening. It has been determined that the direct procurement method facilitates the procurement processes in many aspects by enabling them to serve the public interest but also increases risks of illegal acts due to the fact that the initiatives given to the public officials engaged in the procurements are not audited through audit mechanisms. It has been emphasized that the establishment of effective internal control mechanisms in public administrations in parallel with the advancing technology will prevent such risks and fragilities. | |
