Özet
Kavâid-i Fıkhiyye'nin günlük hayatın pek çok alanında olumlu etkileri vardır. Nitekim bu bilim sayesinde farklı fıkhi meseleler ve çağdaş uygulamalar, fıkhi kurallar temelinde bir araya getirilmiş, genel şerî metinlerden veya başka kaynaklardan çıkarılan kısa, özlü hükümler içeren kurallar şeklinde bir çatı altında toplanmıştır. Bu kısa hükümler, anlaşılır ve uygulamaya kabil olup bazen muteber bazen de destekleyici veya açıklayıcı bir delil olarak kabul edilir. "Adetlerin hakemliği" ilkesi, toplumun gelenek ve âdetleriyle ilgili olan önemli bir kavâid-i fıkhiyyedir. Nitekim bu kural altında birçok fıkhi alt kural bulunur ve bu kural, kadı ve müftüler için verimli bir kaynaktır. Çünkü farklı fıkhi meseleleri bir araya getirir ve karşılaşılan güncel olaylarla ilgili birçok konuyu ele alır, bu olayların hükümlerini düzenler. Bu kural sayesinde çağdaş fıkhi konuları temel prensiplere dayandırarak ele almak daha kolay hale gelir. Söz konusu külli kaidenin önemine binaen bu çalışmada bu temel kaidenin altında yer alan altı kaide incelenmiştir. Bu bağlamda "Adet muhakkemdir" ilkesinin alt kaidelerinin sınırsız olduğuna, gelenek ve göreneklere göre yenilendiğine ve birçok şerî konuyla ilişkili olduğuna dikkat çekilmiştir. Dolayısıyla toplumun örfünü esas alan şerî hükümler zamana ve mekâna göre hâkim örfün değişimine bağlı olarak değişebilmektedir. Çalışma kapsamında konuyla ilgili pek çok güncel örneklere yer verilmiştir. Çalışmada yer verilen örneklerin tamamında referans olarak Kitap, sünnet vb. edille-i şeriyye esas alınmıştır. Bu durum, insanların günlük yaşamlarına ve değişen olaylarına temas eden çalışmanın özelliklerinden biridir.
Kavâid-i Fıkhiyye has positive effects in many areas of daily life. As a matter of fact, thanks to this science, different fiqh issues and contemporary practices have been brought together on the basis of fiqh rules and gathered under one roof in the form of rules containing short, concise provisions derived from general sharia texts or other sources. These brief provisions are understandable and applicable, and are sometimes regarded as authoritative and sometimes as supporting or explanatory evidence. The principle of "arbitration of customs" is an important principle of fiqhiyyah related to the traditions and customs of the society. As a matter of fact, there are many fiqh sub-rules under this rule and this rule is a productive source for kadis and muftis. Because it brings together different fiqh issues and deals with many issues related to current events and regulates the provisions of these events. Thanks to this rule, it becomes easier to deal with contemporary fiqh issues based on basic principles. Due to the importance of the universal base in question, six bases located under this basic base were examined in this study. In this context, it is pointed out that the sub-rules of the principle of "Custom is absolute" are unlimited, are renewed according to traditions and customs, and are related to many Sharia issues. Therefore, sharia provisions based on the customs of the society may change depending on the change in the dominant customs over time and place. Many current examples on the subject are included within the scope of the study. In all the examples included in the study, the Book, the Sunnah, etc. are used as references. edille-i şeriyye is taken as basis. This is one of the features of the work that touches on people's daily lives and changing events.
