Abstract
Kamu yönetimi alanında bürokrasinin yeniden değerlendirilmesi sonucunda, Tapu ve Kadastro Genel Müdürlüğü tarafından yürütülen faaliyetlerde de reform süreci başlatılmıştır. 2005 yılında TBMM ’ de kabul edilen 5368 sayılı Lisanslı Harita Kadastro Mühendisleri ve Büroları Hakkında Kanun ile, TKGM tarafından yürütülmekte olan, kadastro teknik hizmetlerinden tescile tâbi olmayan işlemlerin yapım ve kontrolü, tescile tâbi olan işlemlerin yapım sorumluluğu lisanslı harita kadastro mühendislik bürolarınca yerine getirilmesi öngörülmüştür. Lisanslı Harita Kadastro Mühendislik Bürolarının faaliyete başlaması ile birlikte kadastro hizmetlerinin daha etkin ve hızlı yürütülmesi amaçlanmaktadır. Bu çalışmada, Ülkemizde faaliyet gösteren Lisanslı Harita Kadastro Mühendislik Bürolarının Lisans koşulları ile yetki alanları irdelenmiş ve Avrupa Birliğine üye ülkelerdeki Lisanslı bürolarla karşılaştırılmıştır. Lisanslı Harita Kadastro Mühendisleri ve Büroları Hakkında Yönetmelik gereği Lisanslı Büroların görev, yetki ve sorumlulukları ile personel ve donanım durumları incelenerek Aksaray Kadastro Müdürlüğü çalışma alanında değerlendirilmesi yapılmıştır. Araştırmada, Aksaray kadastro müdürlüğü yetki alanında faaliyet gösteren iki adet lisanslı büroya 2013 yılında hizmet alımı amacıyla başvuruda bulunan talep sahiplerinin, Lisanlı bürolara ve faaliyetlerine bakışı, lisanslı bürolar tarafından yürütülen hizmetlerin ve hizmet alanlarının yeterlilikleri ile müşteri memnuniyeti anketleme yöntemiyle irdelenmiştir. Araştırma ile, talebe bağlı teknik hizmetlerin LİHKAB’lar tarafından yapılması ile TKGM’ nin yol gösteren ve denetleyen konumda olduğu, kadastro bilgilerinin güncellenmesi ve sürdürülmesi gibi asıl yapması gereken faaliyetlere yönelmiş olmasının yanında, özel sektörün katılımının yoğun bürokrasi nedeniyle hantal işleyen devlet yapısını değiştirdiği ayrıca hizmetlerin kadastro müdürlükleri yerine LİHKAB’ lar tarafından yürütülmesinin, hem kurum hem de hizmeti alan vatandaşlar açısından verimli olduğu sonucuna varılmıştır.
In the field of the administrative activities of a government resulting re-evaluation of the bureaucracy, the activities conducted by the General Directorate of Land Registry and Cadastre reform process has been initiated. In 2005, via the Licensed Engineers and Bureau of Cadastral Map No. 5368 and Law which adopted in the Parliament, It was decided to be carried out by the licenced cadastral maps engineering offices the responsibility for the construction of which is subject to registration process, have been conducted by TGKM, that is, cadastre of technical services and those operations are not subject to the registration and control of the construction. With the opening of the Licensed Surveying offices the activities, It is aimed that cadastral services to be carried out more efficiently and quickly. In this work, the licence conditions and jurisdictions of Cadastral Map of Licensed Engineering Firms in our country was investigated and compared with the European Union member countries having Licensed Offices. With regard to the Regulation on the Cadastral Map of Licensed Engineers and the Bureau ,by examinig the Licensed Office of the duties, powers and responsibilities, personnel and equipment status, evaluations were made on in the workspace of Aksaray Cadastre Directorate. In this work, view points of the claimants have been operating in Aksaray 2013 to the licensed offices and their operations, services and customer satisfaction with the adequacy of the service area conducted by licensed offices were all studied with sample survey. With the Research, It has been concluded that for both institution and people on request made by the technical services with LİHKAB and TKGM 's position being as controlling and supervising,as well as,the updating of the cadastral information and maintaining such activities-the participation of private sector has changed the gawky state structure due to excessive bureaucrac-as well as,services are being conducted by LİHKAB instead of cadastra offices.
