İspirli Ömer Efendi’nin Ferâiz Risâlesi Bağlamında Zevi’l-Erhâm Meselesine Dair Çözümler

| dc.description.abstract | Temel esasları naslarla belirlenen ferâiz ilmi, Peygamberimizden sonra fıkıh kitaplarında ayrı bir bölüm olarak ele alınmış ve zamanla geliştirilerek önemli çalışmalar ortaya konulmak suretiyle geniş bir literatür oluşturulmuştur. Bu çalışmalardan biri de Hanefî mezhebi bağlamında konuyu ele alan Sirâciyye’dir. Bu eser üzerine yapılan çok sayıda çalışmadan biri de sadece zevi’l-erhâm bölümü üzerine İspirli Ömer Efendi’nin yazmış olduğu şerhtir. Bu çalışmada öncelikle tabakat kitaplarından ve başta Hamdiyye risâlesi olmak üzere kendi risâlelerinden istifade edilerek Ömer Efendi’nin hayatı, ilmi şahsiyeti ve eserleri hakkında bilgi verilecektir. Diğer alanlarda kaleme aldığı eserlerine ulaşılabilecek kaynaklara işaret edildikten sonra fıkıh alanındaki telifleri kısaca, bu çalışmanın konusu olan Ferâiz Risâlesi ise etraflıca tanıtılacaktır. Böylece, ferâiz ilminin şaheserlerinden biri olan Sirâciyye’nin zevi’l-erhâm bölümünün birinci sınıfına dair şerhini içeren Ferâiz Risâlesi’nin tenkitli neşri ile söz konusu eser bilim dünyasının dikkatine sunulacaktır. Bu risâle, aynı eser üzerine yazılan şerhlerden farklı olarak Sirâciyye’de yer alan problemlerin çözümüne dair getirdiği formül niteliğindeki izahlar bakımından önem arz etmektedir. Müellifin bu açıklamaları ve kısaca değindiği problemlerin çözüm aşamaları ise ayrı ayrı tablolar halinde izah edilerek mütevazı bir katkı hedeflenmektedir. Ayrıca yapılan bu çalışmayla, benzer meselelerin çözümünü kolaylaştıracak metotların geliştirilmesi ve konuyla ilgili pratik çözüm yollarının ortaya konulması amaçlanmaktadır. | |
| dc.description.abstract | The science of inheritance, the foundations of which are determined by the na?? (Quranic verses and hadith), has been treated as a separate section in the jurisprudence books after the Prophet and has developed over time, resulting in significant studies and an extensive literature on the subject. One of these studies is Sir?jiyyah, which deals with the subject in the context of the ?anaf? school of thought. One of the numerous commentaries written on this work is a commentary specifically on the dhawy al-ar??m section, written by Ispirli Omer Efendi. In this study, firstly, information about Omer Efendi’s life, academic personality, and works will be provided by utilizing the biographical dictionaries and his treatises, primarily the Ris?lah of Hamdiyya. After pointing to sources where his works in other fields can be reached, his authorship in the field of jurisprudence will be briefly introduced, and the Ris?lah of Far?id?, which is the subject of this study, will be presented in detail. In this way, the critical edition of the Ris?lah of Far?id?, which contains the commentary on the first class of the dhawy al-ar??m section of Sir?jiyyah, one of the masterpieces of the science of inheritance, will be offered to the attention of the scholarly world. This treatise is of particular importance in terms of the formulaic explanations it offers for the resolution of the problems found in Sir?jiyyah, distinguishing it from other commentaries written on the same work. The author’s explanations and the resolution stages of the briefly mentioned problems will be explained in separate tables, aiming for a modest contribution. Moreover, this study aims to develop methods that will facilitate the solution of similar issues and present practical solutions related to the subject | |
