dc.description.abstract	Nüşûz, eşlerin evlilik hukukuna riayet etmemesini ve birbirlerine karşı geçimsiz olmalarını ifade eden bir terimdir. Kur’ân-ı Kerîm, kadın ve erkeğin nüşûz durumlarına ayrı ayrı temas etmiş, bunlara ilişkin bazı çözüm yolları tavsiye etmiştir. Nisâ 4/34 âyetinde kadının nüşûzuyla ilgili olarak, kadına öğüt verilmesi, yatağın ayrılması ve fizikî ceza verilmesi/dayak şeklinde bir sürecin takip edilmesi tavsiye edilirken, kocanın nüşûzundan söz eden Nisâ 4/128 âyetinde eşlerin aralarında sulh etmeleri öğütlenmiştir. Kadının nüşûzuna ilişkin daha fazla detayın zikredilmesinden kaynaklı olsa gerek hem klasik fıkıh kitaplarında hem de günümüz akademik çalışmalarda genellikle kadının nüşûzu üzerinde durulmuş, kocanın nüşûzuna fazla temas edilmemiştir. Oysa aile bütünlüğüne karşı oluşturduğu tehdit bakımından kadın ve erkeğin nüşûzu arasında bir fark yoktur. Ancak mahiyetlerindeki farklılık sebebiyle, çözüm yöntemleri bakımından birbirlerinden ayrılırlar. Bu çalışma, nüşûzun tanımını, kocanın nüşûz sayılacak davranışlarını ve bunların çözüm yollarını ele almaktadır. Fetva ve içtihatların esas alındığı çalışmada, kocadan kaynaklı nüşûzların genellikle sorumluluğun terki ya da eziyet kaynaklı olduğu ortaya konulmuş; kocanın nüşûzlarına karşı uygulanacak çözüm yolları ise sulh, icbar ve tefrik şeklinde üç aşamada ele alınmıştır.
dc.description.abstract	Nush?z is a term that refers to the spouses’ disregard for marital law and their incompatibility between. The Holy Qur’?n has addressed to the cases of nush?z for men and women separately and recommended some solutions. In Nis?? 34, that mentions the nush?z of the wife, the husband is advised to follow a process of admonishing, separating the bed and physical punishment/beating, while in Nis?? 128 that mentions the nush?z of the husband, the spouses are advised to make amends. Due to the fact that more details are mentioned regarding the wife’s nush?z, both classical fiqh books and contemporary academic studies generally focus on the wife’s nush?z and do not touch upon the husband’s nush?z upon much. However, there is no difference between male and female nush?z in terms of the threat it poses to the integrity of the family. Due to the difference in nature, they differ from each other in terms of their methods of resolution. This study deals with the definition of nush?z, the behaviors of the husband that are considered nush?z and the solutions to these behaviors. In the study, based on fatwas and jurisprudence, found that the husband’s nush?z usually takes the form of abandonment of responsibility or oppression of the wife; the remedies that are ?ul?, ijb?r and tafr?q to be applied against these nush?zes are discussed in three stages.
