Abstract
Aile müessesesinin temelini teşkil eden nikâh akdi, ferdî, içtimaî, dinî ve dünyevî yönlerin yanında hukukî boyuta da sahiptir. O bakımdan diğer hukukî tasarruflar gibi birtakım rükün ve şartları barındırmak durumundadır. Aksi takdirde dinen ve hukuken muteber sayılıp kendisine sonuç bağlanabilmesi mümkün değildir. Söz konusu önemine binaen İslâm hukukçuları nikâh akdi ile ilgili meseleleri en ince ayrıntısına kadar ele almış ve bu bağlamda hem rükün hem de şartlarını tüm detaylarıyla açıklığa kavuşturmuşlardır. Ancak bazı konularda ihtilaf etmişlerdir. Nikâh akdinin rükün ve şartlarına dair birçok ihtilaf bulunmakla beraber en çok tartışmaya konu olmuş meselelerin başında, velâyet meselesi gelmektedir. Bu çerçevede farklı delil, gerekçe ve bakış açılarına bağlı olarak kimlerde velâyet yetkisinin bulunduğu, velâyet yetkisinin kimler üzerinde cari olduğu, velâyette yetki sınırının ne olduğu ve velâyeti üstlenen kişinin (velinin) nikâh akdi açısından nasıl bir unsur sayıldığı konularında farklı yaklaşımlar sergilenmiştir. Bu çalışmanın amacı, karşılaştırmalı olarak İslâm hukukçularının nikâhta velâyet ile ilgili görüşlerinin ele alınması ve dayandıkları delillerin incelenmesidir.
The marriage contract, which forms the basis of the conjugal union has individual, social, religious, and secular aspects, but also has a legal dimension. In this respect, it has to contain some elements and conditions like other legal practises. Otherwise, it is not possible to be considered religiously and legally valid. Due to its importance, Isl?mic jurists have dealt with the issues related to the marriage contract down to the last detail, and in this context, they have clarified both the elements, and the conditions in detail. However, they agreed on some issues and disagreed on others. Although there are many disputes about the elements and conditions of the marriage contract, the most controversial point is the issue of custody. In this context, different approaches have been put forward depending on different evidences, reasons, and perspectives about who has custody, who is subject to custody provisions, what is the limit of authority regarding custody and what is the current marital situation of the person who undertakes the custody. This study aims to comparatively examine the views of Isl?mic jurists about custody in marriage and to examine the evidence they are based on.
