dc.description.abstract	ظهر في التاريخ اإلسالمي فقهاء أجالء قد برزوا في العلم، وشهد لهم العلماء، ومن هؤالء العلماء اإلمام أب ي إسحاق المروزي رحمه هللا )ت 340 هـ(، فقد كان إمام جما هير الشافعية وكبيرهم، وقد بذل اإلمام وقته وحياته في التعلم والتدريس والتأليف، وقد لمع نجمه وظهرت جهوده، حيث قام بتأليف عدد من الكتب النافعة في الفروع واألصول التي صارت مرجعًا ومصدًرا ينهل منه العلماء. قام الباحث بجمع اآلراء الفقهية لإلمام المروز ي من كتاب القتل وكتاب الصيد والذبائح وكتاب األضحية وكتاب األطعمة، وذلك من كتاب الحاوي الكبير لإلمام الماوردي رحمه هللا )ت 450 هـ(، فبدأ البحث بالتعريف بشخصية اإلمام ين الماوردي والمروزي وبيئتهما ومكانتهما العلمية، ثم توسع في ترجمة اإلمام المروزي وأنه كان كبير شيوخ الشافعية في عصره، ثم بعد ذلك ذكر اآلراء الفقهية ذكِر رأي اإلمام لإلمام المروزي في حدود البحث ، وذلك من خالل تصوير المسألة بطريقة مناسبة، ثم يُ المروزي أوال،ً ثم بعده آراء العلماء الذين ذكرهم الماوردي في كتابه، ذو الصبغة الشافعية، وهم من علماء الشافعية، وقد يذكر غيرهم، ثم يذكر الباحث ما ترجح لديه منها، وختا ًما فقد توصل الباحث لنتائج عد يد ة مهمة، ومن أهمها أن اإلمام المروزي فقيه أصولي منضبط، فيجب االعتناء بعلمه، وأن آراء اإلمام لم تكن عن هوى أو تقليد أعمى لمن سبقه، بل عن اجتهاد ونظر عمي ق، فقد يخالف من سبقه من أئمة المذهب وقد يوافقهم.
dc.description.abstract	Tarih boyunca fıkıh alanında birçok büyük âlim yetişmiş ve ilim sahasında ön plana çıkmıştır. Bu âlimlerden biri, Hicri 340 (Miladi 951) yılında vefat eden İmam Ebû İshak el-Mervezî'dir. Şafiî mezhebinin öncü âlimlerinden biri olan el-Mervezî, hayatını ilme, öğretime ve telife adamış, fıkhî konularda birçok değerli eser kaleme almıştır. Bu eserler zamanla muteber kaynaklar haline gelmiştir. Bu çalışma, özellikle "katl, av, kurban ve gıda" gibi fıkıh meselelerine odaklanarak el-Mervezî'nin görüşlerini derlemektedir. Bu derleme, İmam el-Mâverdî'nin (Hicri 450 / Miladi 1058) değerli eseri "el-Hâvî" esas alınarak yapılmıştır. Çalışma, öncelikle İmam el-Mâverdî ve el-Mervezî'nin şahsiyetleri, ilmi konumları ve eserlerinin değerlendirilmesiyle başlamış, ardından el-Mervezî'nin hayatı ve Şafiî mezhebindeki konumu detaylı bir şekilde ele alınmıştır. Araştırma ayrıca el-Mervezî'nin görüşlerini, diğer Şafiî âlimlerin yaklaşımlarıyla karşılaştırmış ve geniş bir bakış açısıyla ele almıştır. Çalışma sonucunda, İmam el-Mervezî'nin derin bir içtihat anlayışı ve titiz ilmî metodolojisi olduğu ortaya konmuştur. Onun ilmî görüşleri, şahsi eğilimlerden veya körü körüne taklitten uzak, derin içtihadi analizlere dayanmaktadır. Mezhebin esaslarına bağlı kalarak meseleleri kapsamlı ve geniş bir şekilde değerlendirmiştir.
dc.description.abstract	Throughout Islamic history, there have emerged esteemed jurists renowned for their scholarship, acknowledged by scholars of their time. Among these prominent figures is Imam Abu Ishaq Al-Marwazi, may Allah have mercy on him (d. 340 AH), who was the leading scholar of the majority of Shafi'i jurists and held a distinguished position among them. The Imam devoted his time and life to the pursuit of knowledge, teaching, and authorship. His contributions and efforts became widely recognized, as he authored numerous beneficial works on both practical jurisprudence and fundamental principles, which have since served as reference materials and sources from which scholars draw. The researcher compiled the legal opinions of Imam Al-Marwazi from the Chapter of Killing, the Chapter of Hunting, the Chapter of Sacrifices, and the Chapter of Foods, sourced from the comprehensive work "Al-Hawi Al-Kabir" by Imam Al-Mawardi, may Allah have mercy on him (d. 450 AH). The study commenced with an introduction to the personalities of both imams, Al-Mawardi and Al-Marwazi, along with an examination of their respective environments and scholarly standings. Subsequently, the research further delved into a detailed biography of Imam Al-Marwazi, emphasizing his status as the preeminent scholar of the Shafi'i school during his era. The researcher presents the legal opinions of Imam Al-Marwazi within the scope of the study, first by framing the issue in an appropriate manner. He then discusses the opinion of Imam Al-Marwazi, followed by the views of the scholars mentioned by Al-Marwazi in his book, which reflects the Shafi'i tradition. These scholars belong to the Shafi'i school of thought, though others may also be included. The researcher concludes by presenting his own conclusions, with one of the most significant being that Imam Al-Marwazi is a disciplined jurisprudential scholar whose knowledge should be valued. Furthermore, the research asserts that his opinions were not driven by personal bias or blind imitation of predecessors, but rather by independent reasoning and deep reflection, which sometimes led him to differ from earlier scholars of the school, and at other times, to agree with them
