Ebû Hanîfe’nin Re’yini hadis ile temellendirmesi ve uygulamaya dair bazı örnekler

| dc.description.abstract | Ebû Hanîfe farklı medeniyetlere beşiklik eden, siyasî ve itikâdî meselelerde ihtilafın merkezi olan ve hadis uydurmanın yoğun olduğu Irak bölgesinde dünyaya gelmiştir. Orada temel dinî bilgileri alarak ilimde derinleşmesi, fıkıh meclisinde talebe ve hoca olarak içtihat alanında uzmanlaşması ve ticaretle iştigal ederek sosyal yapının dinamik yönüne şahit olması onun meselelere karşı bakış açısının çok boyutlu olmasına ve pratik çözümlere yönelmesine katkı sağlamıştır. O, zaman ve mekânın etkisiyle ortaya çıkan sorunların çözümünde hadislerin muradını anlama adına akla ağırlık verdiği için onları yorumlaması, kimi zaman hadise aykırı görüşlerde bulunduğu şeklinde değerlendirilmiş ve bu durum kendisine karşı aşırıya varan ithamların ortaya çıkmasına yol açmıştır. Hâlbuki Ebû Hanîfe’nin re’ye başvurduğu meselelerde o konuya dair nakledilen bazı hadislere zahiren muhalefet ettiği görülmekle birlikte onun görüşünü ortaya koyarken meseleleri diğer rivayetler üzerinden temellendirmiş olabileceğini göz ardı etmemek gerekir. Bu yüzden onun, problemler karşısında çözüm üretirken hem re’yi sebebiyle muhalif kaldığı hadisi hem de görüşünü belirlerken esas aldığı rivayeti bir arada sunan örneklerin tespit edilmesi, Ebû Hanîfe’nin hadise menfî yaklaşım gösterdiği iddiasının gözden geçirmesine katkı sağlayacaktır. | |
| dc.description.abstract | Ab? ?an?fa was born in the region of Iraq which had been a cradle of various civilizations, a centre for con-flicts over political and creedal issues, and where ?ad?th concocting was common-place. The fact that he deepened his knowledge in Islamic fields there by receiving basic religious education, he got his ijtihad expertise as being both a learner and a lecturer at fiqh councils and he witnessed the dynamic side of social life by doing trades facilitated him to gain a multifaceted perspective towards matters and contributed to his approach towards practical solutions. He, in the name of understanding what ?ad?ths meant, attached weight to reason to provide solutions towards problems arisen because of space and time. His interpreta-tions of them were sometimes regarded as heresy and this situation caused an eruption of extreme allega-tions against him. However, it could be thought that Ab? ?an?fa seemingly opposed to some ?ad?ths nar-rated regarding that specific topic in the issues he consulted ra’y. In contrast, it should not be disregarded that he might have grounded the issues in other narrations while putting forth his arguments. Therefore, both the ?ad?th to which he opposed due to his ra’y while providing solutions towards problems and the narration on which he predicated his argument will be presented together. The identification of these ex-amples will contribute to the review of the assumption that Ab? ?an?fa approached ?ad?th in a negative way. | |
