Abstract

Âlemlerin Rabbi olan Allah'a hamd olsun. Kıyamet gününe kadar Allah'ın salât ve selamı nebilerin ve resullerin en faziletlisi Peygaberimiz Muhammed'e, ehli beytine ve arkadaşlarına olsun. İslam dininin üstünlüklerinden biri de her zaman ve her mekân için geçerli olmasıdır. Bundan dolayıdır ki İslam dini tüm problem ve gelişmelere çözüm üretebilecek bir kabiliyete sahiptir. Bu durum; ümmetin fıkıh ve usul âlimlerini, İslamî mirasımıza, fıkıh ve onun usul kuralarının kaynaklarına değinmelerine neden olmuştur. Böylece fıkhî kurallar ve usullerı fakihin başvuracağı bir kaynak olmuştur. Fakih, fıkhî kurallarla her türlü ortaya çıkan mesele ve olay için şeriat çerçevesinde bir hüküm bulur. Bundan dolayı, fıkhi kurallar islam fıkhı ve usulünde önemli bir yer teşkil etmektedir. Bu ilmi konunun önemli olması nedeniyle, tezimin bu alanda yapılmasına karar verdim. Uzun bir araştırma ve okuma sonucu hadis ve fıkıh alanında İslam âlimleri arasında önemli bir yeri olan İmam Abdul'-hay el-Leknevî'nin "Şerh'ül Hidâye" kitabının ibadet bölümündeki fıkhi kuralları ortaya çıkarmayı hedefledik. İmam Abdul'-hay el-Leknevî ve eseri önemli olduğu için kısaca hayatından bahsettik. Bilindiği gibi "el-Hidâye"' kitabı Hanefi âlimler arasında kendisine başvurulan kaynak bir kitaptır. Bu kitap, fıkıh ilminde hazine değerindedir. Eserin yazarı eserinde Hanefi mezhebine dair rivayetin önemlilerini ve dirayet metinlerini toplamıştır. Böylece El-Hidâye kitabı, Hanefî fıkhında en önemli eserlerden biri olmuştur. Bundan dolayı eser, Hanefî âlimler arasında en fazla başvurulan ve en fazla yaygın eser olarak büyük bir önem görmüştür. Tezimizde terminolojide yer alan fıkhî kuralların tanımını açıkladım. Sonra fıkhı kuralların herhangi bir kısımda farklı konular içeridiğini belirttim. Aynı zamanda fıkıh ilminin genel bir çerçeve olduğunu muayyen bir babta, farklı konulara havi olduğuna temas ettim. Daha sonra fıkhi kaidelerle fıkhı kuralları, kanunları açıkladım. Her ikisinin arasındaki fark sonraki asırlarda ortaya çıkmıştır. Her ilmin kendine has bir anlamı olmuştur. Tezimizde aralarındaki benzerliği ve farklılıkları açıkladık. Bu tez yirmi tane kural içererek (Taharet, namaz, zekât, oruç, hac) gibi konuları kapsamaktadır. Çalışmamız esnasında bu kurallardan râcih olanı seçerken mercûh olan kavli eledik.

Praise be to Allah، the Lord of Worlds. May blessings and peace be upon our prophet Muhammad، the most virtuous of prophets and messengers، and his family and companions. Our topic at hand: One of the excellences of the religion of Islam is that it holds true anytime and anywhere and that it comprehends all calamities and developments. This case is something that is done by the ulama، the faqihs and usulists. Whomever makes a classification on fqih and usul mentions the sources of the rules on fqih and usul. They provide accessories and parts of the canon and govern the matters in relation to fqih. Thus، it becomes a tool established by the faqih. Faqih، with the rules and facts of fqih، finds an appropriate canonical law for all kinds of calamities and incidents. The rules and facts for this are accepted as an important subject in Islamic fish and usul. I have decided to write my master's thesis in this sense and due to the importance of this discipline. After a long research and review، I turned towards the book "Alem min Alami'l-Müslimin" and towards an important Imam of Hadith and Fqih، Imam Abdu'l-Hay el-Luknevi. His book that I refer to is Şerhu'l-Hidaye. I turned towards this study in order to put forth the principles of fqih and therefore the portions of worship with the facilitation of Allah Teala. We have mentioned the life of Imam Abdu'l-Hay el-Leknevi elHanefi while considering the importance of this scholar and his works. The book of El-Hidaye is known as a book attributed to the Hanafi ulama. Such that، it is considered a treasure among the treasure of Islamic fqih. The scholar collected the important traditions and texts of wisdom in his book. The book of El-Hidaye has become one of the most famous writings within the Hanafi fqih. It became one of the most trusted and widespread books among the Hanafi ulama and it was given utmost importance and attention. We later explained the rule of fqih in the terminology and mentioned that the role of fqih collected the details within the scope of takbir. This is also a universal command that collects various and different parts under a certain scope. Afterwards، we have explained the differences between the principles of fqih and the rules of fqih. The difference between the two has emerged in the last few centuries and became a document within all disciplines. In a similar manner، we have explained the differences and similarities between the principles of fqih and the rules of fqih. The matter of principles of fqih means the act that one is obligated to carry out. The matter of principles of usul means the document. This subject includes 20 disconnected rules on the worships portion (such as cleanliness، salah، zakat، fasting and haj). The rules that confirm the quality of the rules were selected، and the things that we have observed to be out of the quality of the rules were neglected.
